Waiving Your Patent Case Goodbye: Preserving Issues for Appeal in an Era of De Novo Review
Second Annual Federal Circuit Clerk Roundtable
Chicago-Kent College of Law
565 West Adams, Room 580
Chicago, IL 60661
Monday, October 31, 2005
1:00 - 3:00 pm

The Federal Circuit exercises de novo review over a variety of issues in patent law. Such plenary review creates tension with the procedural rule that issues not raised at the trial court are waived on appeal. The Federal Circuit has not provided much guidance as to waiver and, indeed, has offered seemingly contradictory opinions on the matter. Parties often file cross-appeals to preserve various issues, incurring the ire of the Federal Circuit, as demonstrated in the case Bailey v. Dart Container Corp., 292 F.3d 1360 (Fed. Cir. 2002). The Roundtable, composed of former law clerks at the Federal Circuit, will address this litigation bind.

Sept. 30, 2005

Panel discussion of the July 12, 2005 en banc decision of the Federal Circuit in Phillips v. AWH Corp., et al. The Court clarified certain claim construction issues, but also declined to address other issues, such as the deference (if any) to be accorded the claim construction rulings of the trial court. A panel consisting of Ed Manzo ( Cook Alex McFarron Manzo Cummings & Mehler), Brad Lyerla (Marshall Gerstein & Borun), Tim Vezeau ( Katten Muchin Zavis Rosenman), Pat Burns (Greer Burns & Crain), Dean Monco (Wood Phillips Katz Clark & Mortimer) and Matthew Doscotch (John Marshall Law School) will discuss this important decision and its ramifications and answer questions. Noon at John Marshall Law School . For more information, contact Brad Lyerla, Chair of the Litigation Committee.
